1. The agreement
These Terms of Service ("Terms") are an agreement between you and SHCD.US ("SHCD.US", "we", "us"). They cover the website at shcd.us, the dashboard, the API, the QR code generator, branded custom domains, and every short link or QR code created with them (together, the "Service").
By creating an account, creating a link, or otherwise using the Service, you agree to these Terms, our Acceptable Use Policy and our Privacy Policy. If you use the Service for a business, you're agreeing on behalf of that business and confirming you're allowed to.
2. Your account
- You need to be at least 16 years old, and old enough to form a binding contract where you live.
- Give us accurate information and a working email address. Links can't go live until that address is confirmed.
- Keep your password and API tokens secret. You're responsible for what happens under your account; tell us right away at hello@shcd.us if you think it's been compromised.
- One person per login. Team seats on plans that include them are for the named people they're assigned to.
3. Guest links
You can make a link without an account. Guest links are confirmed through the email address you give us, stay live for 24 hours after confirmation, and are covered by these Terms and the Acceptable Use Policy like any other link. We may limit how many guest links an email address or network can create.
4. Plans, billing and cancellation
Subscriptions
Paid plans are billed in advance, monthly or yearly, through our payment processor, Stripe. Prices are listed on our pricing page in US dollars and exclude any taxes we're required to collect. Your subscription renews automatically at the end of each billing period until you cancel.
Free trials
If a plan includes a free trial, we'll charge the payment method you gave us when the trial ends unless you cancel before then.
Cancelling
Cancel any time from Plan & billing in your dashboard. Cancellation takes effect at the end of the current billing period; you keep paid features until then. We don't give refunds for partial periods, except where the law requires it or where our uptime commitment provides service credits.
Price changes
If we change the price of your plan, we'll email you at least 30 days before it applies to your next renewal. You can cancel before then.
Plan limits
Each plan has limits on dynamic QR codes, monthly scans, branded domains and seats. If you go over a limit, we won't break codes you've already printed. We'll show you the overage and ask you to upgrade. If you stay well over your allowance for two consecutive months after we've asked, we may limit creating new links until you upgrade or usage drops.
Downgrades
If you downgrade or your paid plan ends, existing links keep redirecting. Features your new plan doesn't include (for example, adding a password to a new link) won't be available for new changes.
5. Your links and content
You keep all rights to the destinations, names, logos and other material you put into the Service ("Your Content"). You give us permission to store, process and display Your Content only as needed to run the Service for you: redirecting scans, showing your analytics, generating QR images, and printing merchandise you order.
You're responsible for Your Content and for having the right to use it. Don't use trademarks or names you don't have permission to use, including in custom slugs and branded domains.
6. Safety checks and enforcement
To protect the people who scan codes, we check link destinations against third-party threat lists (such as Google Web Risk) when a link is created or changed, and again regularly afterwards. We also accept reports from the public at shcd.us/report.
We may disable a link, suspend an account, or refuse service if we reasonably believe it breaks the Acceptable Use Policy, puts people at risk, or exposes us to legal liability. Where it's safe and lawful to do so, we'll tell you why and give you a way to respond. A disabled link shows a warning page instead of redirecting; we don't delete your data because of a suspension.
7. Branded custom domains
- You may only connect a domain you own or are authorised to use. You must keep the DNS records we ask for in place.
- We provision and renew TLS certificates for connected domains automatically. If DNS is changed or removed, scans to that domain stop reaching us, and that's outside our control.
- If you remove a domain or your plan no longer includes it, links on that domain stop resolving. Their shcd.us versions keep working.
8. API
API access is subject to rate limits, the usage pricing shown in your dashboard, and these Terms. Don't use the API to resell the Service as a standalone link shortener, to create links in bulk for other people without their consent, or to get around plan limits or safety checks.
9. Merchandise
Merchandise is printed and shipped by our fulfilment partner, Printful. Orders are also subject to the shipping, returns and product details shown at checkout. You confirm you have the rights to any artwork you upload.
10. Our service and intellectual property
The Service, our software, design and brand belong to us and our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. Don't copy, reverse-engineer or resell it, or use our brand in a way that suggests we endorse you. If you send us feedback, we may use it without owing you anything.
11. Availability
We work hard to keep links redirecting around the clock. Our uptime target and the service credits available on Business and Agency plans are described in Uptime & Support. We may change or retire features, but we'll give reasonable notice of changes that materially reduce a paid plan.
12. Disclaimers
Apart from the commitments we make in these Terms and in Uptime & Support, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties such as merchantability, fitness for a particular purpose and non-infringement. Safety checks reduce risk but can't catch everything; we don't guarantee that every destination is safe.
13. Limitation of liability
To the extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if warned they were possible. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $100. Nothing here limits liability that can't be limited by law.
14. Indemnity
If someone brings a claim against us because of Your Content, your links, or your breach of these Terms or the Acceptable Use Policy, you'll cover our reasonable costs of defending it, including any damages awarded and reasonable legal fees.
15. Ending the agreement
You can stop using the Service and delete your account at any time. We can end or suspend your access under section 6, or if you don't pay, with notice where reasonable. When an account is closed, we delete your links and analytics as described in the Privacy Policy. Sections that by their nature should survive (like ownership, disclaimers, liability and disputes) do.
16. Law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Before filing any claim, please email us and give us 30 days to try to resolve it informally. Any claim that isn't resolved will be brought in the state or federal courts located in Florida, and we both consent to their jurisdiction. If you're a consumer in a country whose laws give you the right to bring claims in your local courts, nothing here takes that right away.
17. Changes to these Terms
We may update these Terms. If a change is material, we'll email account holders and post the new version here at least 14 days before it takes effect. Continuing to use the Service after that means you accept the new Terms. The version you accepted at sign-up is recorded on your account.
